Terms of service

1. About the store

Rising Phoenix Shop operates risingphoenixshop.com, an online store selling physical products. These terms govern use of the website and purchases from the store. “We”, “us” and “our” refer to Rising Phoenix Shop; “you” refers to the visitor or customer. Shopify provides the platform hosting our store; it is not the seller of our products.

For questions about an order or these terms, email rggcoaching@gmail.com or call +351 933 472 980.

2. Placing an order

You must have legal capacity to enter into a purchase contract, or act with appropriate authorisation. Please check product options, quantities, delivery details, the total price and these terms before submitting your order. Provide accurate contact and delivery information and keep any account credentials secure.

Submitting an order carries an obligation to pay the total shown at checkout. An automated acknowledgement confirms receipt of your order. Unless acceptance is expressly confirmed earlier, we accept your order when we send a dispatch confirmation. We may decline an order before acceptance for genuine reasons such as unavailable stock, suspected fraud or an obvious pricing error. If payment was taken for an order we cannot accept, we will refund it promptly. We will not substitute goods or charge a higher price without your agreement.

3. Product information and prices

Check each product page for its description, options, measurements, materials and care instructions. Images illustrate the product; screen settings may affect colour appearance, but goods must still match their description and meet applicable legal standards.

The currency and price applicable to your order are displayed at checkout. Applicable taxes, delivery charges and any other charges collected by us must be shown before you place the order. We may change prices for future orders; changes do not alter an accepted order. If we identify an error affecting your order, we will contact you with the available options and respect your statutory rights.

4. Payments

Available payment methods are shown at checkout and are processed through the relevant payment provider. Orders are subject to payment authorisation and reasonable fraud-prevention checks. We will never ask you to send full payment-card credentials by email. Any third-party payment terms apply to that provider’s service without limiting our responsibilities as the seller.

5. Delivery

Available destinations, delivery charges and any delivery estimate provided are shown during ordering. Products may be dispatched from different suppliers or warehouses and arrive separately. We remain responsible for our obligations to you even where a supplier or carrier fulfils an order.

We will deliver within the time agreed with you or, if no time was agreed, within the period required by applicable law, generally no later than 30 days after the contract is concluded for EU consumer orders. If delivery is delayed or an order is lost, contact us. You retain any right to set an appropriate additional delivery deadline, cancel and obtain a refund, including any right to cancel immediately where the law permits.

For consumer orders, the risk of loss or damage normally passes when you or your nominated recipient takes physical possession, subject to any lawful exception where you independently commission a carrier we did not offer. Import duties or other destination charges not collected by us will be disclosed where applicable before purchase; contact us if the charges are unclear.

6. Returns, cancellations and legal guarantees

Our Refund Policy explains the 14-day withdrawal period, return procedures, shipping costs and refunds. Customers pay change-of-mind return shipping where disclosed before purchase; we cover necessary return costs for valid damaged, faulty or incorrect-item claims.

Mandatory consumer protections apply independently of any commercial policy. Goods must conform to the contract. Where applicable, you may seek repair, replacement, a price reduction or termination and a refund under the conditions set by law. New movable goods sold to consumers in Portugal generally have a three-year legal conformity guarantee. Nothing here excludes or shortens those rights.

7. Responsible website use

Do not use the site for fraud, unlawful purchases, infringement, malware distribution, unauthorised access or interference with the service. We may restrict misuse proportionately, without removing rights relating to an existing lawful order. Product information does not replace professional medical advice. Use products only as instructed and observe any age, safety or suitability information.

8. Website content and external services

Website text, design, branding and images belong to us or their respective rights holders. You may view the site and retain information needed for your purchases and legal rights. Other reuse requires the relevant permission or another lawful basis. Links to third-party services are provided for convenience; separate terms may govern those services. They do not transfer our seller obligations to another party.

9. Personal information

Our Privacy Policy describes how personal information is handled. Supply only information reasonably needed for your order or enquiry. Do not send sensitive payment details by ordinary email.

10. Responsibility and events outside our control

We are responsible for performing our contractual and legal obligations. Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud, wilful misconduct, gross negligence or death or personal injury where applicable. Mandatory consumer remedies remain available.

If an event outside our reasonable control disrupts delivery or site availability, we will take reasonable steps to reduce its impact and inform affected customers where appropriate. Such an event does not automatically remove your right to cancel, a refund or another legal remedy.

11. Complaints and disputes

Please contact us first with your order number and a description of the issue so we can try to resolve it. You may also seek assistance from the Portuguese Directorate-General for Consumer Affairs and consult its list of consumer alternative dispute resolution bodies. Cross-border EU consumers may contact their European Consumer Centre. These options do not prevent you from exercising any right to use a competent court or mandatory consumer arbitration.

12. Applicable law and changes

Portuguese law applies, without depriving consumers of mandatory protections of the law that applies in their country of habitual residence where those protections apply. No clause requires a consumer to bring a claim exclusively in a court that would remove rights granted by applicable law.

The terms presented when you order govern that purchase. Later updates apply prospectively. If a provision is unenforceable, the remaining provisions continue only to the extent permitted by law. Contact us if you need a copy of the terms applicable to your order.
